Law enforcement claimed that the vehicle swerved through traffic between 20th and 32 street northbound in Lower Manhattan.

The New York Police also maintained that Cake Boss was unsteady on his feet and blew over the legal limit on a breath test.  He also smelled of alcohol a sign of consumption, not intoxication.  Much fun was made of his alleged statement to police, “You cannot arrest me.  I am the Cake Boss.”  His reality show status did not prevent his arrest.
